1 Acceptance of Terms
By accessing and using Lykinsai's AI automation services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. These terms constitute a legally binding agreement between you and Lykinsai.
If you do not agree with any part of these terms, you must not use our services. Your continued use of our services following any changes to these terms will constitute acceptance of those changes.
Important: These terms apply to all users of our services, including but not limited to website visitors, clients, and users of our AI chatbot solutions.

Lykinsai provides custom AI automation solutions including but not limited to:

- Workflow automation systems
- AI integration solutions for existing business systems
- Custom AI processing and data automation
- Consultation and strategy services for AI implementation
Our services are designed to help businesses streamline operations, improve efficiency, and enhance customer engagement through intelligent automation.
Service Availability
While we strive to provide continuous service availability, we do not guarantee uninterrupted access to our services. Scheduled maintenance and updates may temporarily affect service availability.
3 User Obligations and Acceptable Use
By using our services, you agree to:
- Provide accurate and complete information when required
- Use our services only for lawful purposes and in accordance with these terms
- Not attempt to interfere with, disrupt, or damage our services or systems
- Respect the intellectual property rights of Lykinsai and third parties

6 Payment Terms and Conditions

- Late payments subject to 1.5% monthly interest

- ACH bank transfers
- Wire transfers for large amounts
- Net 30 terms for qualified businesses
Refund Policy
Refunds are handled on a case-by-case basis. Custom development work is generally non-refundable once commenced. Monthly service fees may be prorated for early termination.
7 Limitation of Liability
To the maximum extent permitted by law, Lykinsai's liability for any claims arising from or related to our services is limited as follows:

- Our total liability shall not exceed the amount paid by you for services in the 12 months preceding the claim
- We are not liable for indirect, incidental, special, or consequential damages
- We do not warrant that our services will be error-free or uninterrupted
- You acknowledge that AI technology may have inherent limitations and occasional inaccuracies
Disclaimer of Warranties
Our services are provided "as is" without warranties of any kind, either express or implied. We disclaim all warranties including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
You agree to indemnify and hold harmless Lykinsai from any claims, damages, or expenses arising from your use of our services or violation of these terms.
8 Termination Conditions
Either party may terminate the service agreement under the following conditions:
Termination by You
- • 30-day written notice for ongoing services
- • Immediate termination for cause
- • All outstanding fees must be paid
- • Data export available for 90 days
Termination by Us
- • 30-day notice for convenience
- • Immediate termination for breach
- • Non-payment after 30 days
- • Violation of acceptable use policy
Post-Termination
Upon termination, you will lose access to our services, but we will provide reasonable assistance in data migration. Certain provisions of these terms will survive termination, including intellectual property rights and limitation of liability.
9 Dispute Resolution
We are committed to resolving disputes fairly and efficiently. Our dispute resolution process follows these steps:
Direct Communication
Contact us directly at elijahlykins@lykinsai.com to discuss and resolve the issue informally.
Formal Mediation
If direct communication fails, we agree to participate in mediation through a mutually agreed mediator.
Binding Arbitration
Unresolved disputes will be settled through binding arbitration in accordance with the rules of the American Arbitration Association.
Governing Law
These terms are governed by the laws of Utah, United States, without regard to conflict of law principles. Any legal proceedings must be brought in the state or federal courts located in Utah.
10 Changes to Terms
We reserve the right to modify these Terms of Service at any time. When we make changes, we will:
- Update the "Last updated" date at the top of this document
- Notify you via email if you have an active service agreement
- Post a notice on our website for at least 30 days
- Provide a summary of significant changes
Your Continued Use: By continuing to use our services after changes take effect, you accept the modified terms. If you do not agree with the changes, you may terminate your service agreement.
